BlendJet Portable Blender Recall

On December 28, 2023, BlendJet announced that it is voluntary recalling 4.8 million of its BlendJet2 blenders. The recall news was approved by the U.S. Consumer Product Safety Commission. The company, stated in the recall notice that “BlendJet 2’s currently for sale are NOT impacted by the recall.” BlendJet added that the earlier versions of the BlendJet2 had a risk of the blender overheating or the breaking of the blender blades.

Why was BlendJet recalled?

The CPSC announced that the recalled blenders can pose fire and laceration hazards to consumers due to the overheating issue.

BlendJet announced that it will provide owners of affected units who register with a free replacement base unit for the defective product. Retailers like Costco announced that their customers could alternatively return their blender and receive a full refund.

This recall covers approximately 4.8 million BlendJet 2 Portable Blenders sold in a variety of colors and designs.

The recalled blenders were sold at stores like Costco, Walmart, Target, and other stores nationwide from October 2020 through November 2023. They could also have been purchased online via BlendJet website during the same time period, retailed for $50 to $75.

About 329 reports of the blades breaking while in use, as well as 17 reports of overheating or fires, have been received by the company. These reports have resulted in property damage claims totaling about $150,000. About 49 reports of minor burns and one report of a laceration injury have been received by the company.

Customers who own the recalled blenders are advised to stop using the BlendJet portable blenders right away. The recall also stated that BlendJet will provide a free replacement BlendJet 2 base unit upon request.

How do I return a recalled BlendJet?

Is this your query?

To obtain a free replacement base, customers are advised to take out and cut the rubber seal from the base of their recalled blender into three or more pieces. They can upload or email a photo of the unit’s serial number on the bottom and the broken rubber seal to BlendJet at safety@blendjet.com or www.blendjet.com/safetyandrecall.

“Units where the first 4 digits of the serial number are between 5201 and 5542, and are subject to the recall must be identified through the use of the “Is my BlendJet 2 Recalled?” tool located at www.blendjet.com/safetyandrecall- says CPSC.

What is the lawsuit against BlendJet?

BlendJet blender lawsuits are slowly booming from the customers who underwent injuries and damages due to the product defect. On September 6, 2023, GR Firm announced the launching of a class action lawsuit against BlendJet, Inc.

The lawsuit 7:23-cv-07911 S.D.N.Y. alleges that BlendJet’s marketing claims about its portable blender’s capabilities are misleading the customers. The plaintiffs have come up with many reports where they have encountered defects, making their BlendJet portable blenders unusable.

However as per the manufacturers, they have “updated the base of the BlendJet 2 to feature thicker blades and an improved electrical configuration.” These updates were incorporated “many months ago” into newly-manufactured BlendJet 2 blenders, according to a press release on December 28, 2023.

NutriBullet Blender Lawsuits

NutriBullet blender lawsuits also share the ground of blender lawsuits like BlendJet. The manufacturer of NutriBullet blenders, Homeland Housewares, is currently facing lawsuits by many customers in the US.

An American woman Wendy Littlefield, claims her NutriBullet “suddenly malfunctioned” while she was blending canned tomatoes and beans. The incident caused severe damage to her right hand. Her injuries left her with nerve damage and cuts.

As per the lawsuit, Homeland Housewares should have known its machines were “unreasonably dangerous and defective when used for its intended use”. Her daughter Cambrie wrote on Facebook: “My mother’s life will never be the same, considering she will likely never be able to use her dominant hand again and she rides a roller coaster of never-ending pain and constant surgeries. This is a tragedy I hope no one else has to endure.”

Another plaintiff, Pete Damiano, claims that he had suffered severe facial injuries while making a sauce using the blender. Though not permanently blinded, his eyeball was severely injured with hot, sticky sauce. As per the lawsuit, his face was also injured, requiring months of treatment.

Many plaintiffs had claimed second-degree burns on their arms and chests while operating the blender. When the explosion occurred, some individuals were in the process of reaching for the canister, causing severe cuts from the blades of the blender.

However, NutriBullet had defended back strongly, arguing that when operated correctly in accordance with the directions provided in the instruction manual, which is nine pages long, users would not face any issues. As per the company, “there are clear warnings against incorrect and improper use repeated throughout the instruction manuals.”

  • A design defect
  • A manufacturing defect
  • A marketing defect

Expert testimony regarding how the product was designed in a way that rendered the device unreasonable dangerous is necessary to establish a design defect. When a distributor or manufacturer neglects to give appropriate instructions regarding the product’s safety and usage, it is considered a marketing defect.

The Stand of the Defendants in Portable Blender Injury Lawsuits

The manufacturers in portable blender lawsuits like NutriBlend  and BlendJet defend the arguments of the victims, stating that their products would have been safe if used under safe conditions, following the safety manual. The companies may not accept that the product defect has caused damages to the plaintiffs.

How to prove liability in portable blender injury lawsuits?

Plaintiffs in portable blender lawsuits, like any other product liability lawsuits, need to prove the manufacturer was negligent. However, they should prove the product was defective and that defect caused damages to them. Seeking the support of an expert blender lawsuits attorney will help the victim grab the best compensation for their injuries and damages.

It may sound simple, but for the victims to fight against these business sharks is a herculean task, especially when the manufacturers try to shadow the manufacturing defect with their safety warnings in the user manual. Moreover, the manufacturers and their insurance companies and lawyers would try to allege that the plaintiffs must have been injured while improperly using the product.

The plaintiffs in portable blender lawsuits can have a strong argument by establishing medical evidence that support their damages caused by the defective blender.

How to prove injuries in portable blender claims with medical record reviews?

In any personal injury lawsuit, including blender defects, gathering comprehensive medical evidence is essential. Medical record reviews involve obtaining all pertinent medical records related to the plaintiff’s injuries.

These records typically include doctor’s notes, diagnostic tests, surgical reports, and any other medical documentation that details the extent of the injuries and their progression.

By going through the medical evidence, attorneys can present a clear and cohesive narrative to the court, demonstrating the connection between the use of the Blender and the injuries sustained.

Determining Causation

One of the most critical aspects of a product liability lawsuit involving a blender is establishing causation, i.e., proving that the injuries were a direct result of using the blender. Expert medical record reviewers can review the medical records and pick the causation. They assess whether the injuries align with the type of harm that could be caused by the product, considering factors like the nature of the injuries and the timeline of events.

Expert medical opinions are also invaluable in demonstrating to the court that there is a link between the use of the blender and the injuries suffered. Medical opinions can also help in establishing the treatment underwent by the plaintiff was reasonable and also the need for future medical support and its expenses.

Assessing Damages

Accurate calculation of damages is crucial to ensure the plaintiff receives fair compensation for their losses. Medical record reviews can mirror the detailed information about medical expenses incurred, such as hospital bills, surgeries, medication costs, and rehabilitation. They can represent the emotional and physical suffering experienced by the plaintiff.
